Disciplinary hearings will be scheduled within seventy-two (72) hours (excluding weekend and holidays), after the alleged violation. You will be notified twenty-four (24) hours prior to the hearing, unless you sign the Waiver of Twenty-Four Hour Notice. Hearings may be postponed or continued for a reasonable time for good cause. You will be notified in writing of any postponements. You have the right to be present during the hearing, make statements and present documented evidence. You may also request three (3) witnesses in your defense. Witnesses may testify in person or by written statement. You may waive the right to be present by submitting a written request. Your presence and/or the presence of your witnesses at the hearing could be denied if behavior and/or conduct poses a threat to the safety and security of staff and the facility. If you choose to waive your right to a formal hearing, you will sign the Disciplinary Hearing Form and be dismissed from the hearing. The Committee will then base their decision solely on the reports and any investigation results. If you agree to a formal hearing, you will be allowed to present your case only to the degree necessary to present the facts. The Hearing Committee can deny the testimony of witnesses if the testimony is not relevant to the case. The reason for denial of any witnesses will be read into the record and also stated in writing. The reporting officer and/or staff member will also be given an opportunity to testify. Following the completion of all testimony, the hearing will be concluded and you will be returned to your housing unit. The Hearing Committee Member will consider all evidence and testimony in order to reach a decision. Sanctions will be imposed according to recommended sanction guidelines. If you are found innocent, you will be placed on the move list and moved according to reclassification and housing assignment policy. If you are found guilty, you will be assigned to a disciplinary segregation cell for the term of the sanction. You will also be given a copy of the decision and advised of your right to appeal the decision.
